I have talked to some about this, but if there is no issue to go to trial over besides the simple fact they don't want to stip or settle what is the purpose behind this tactic besides the obviuos delay deny ?

My atty. states that because of this he will call my adjuster to the stand at trail and ask him the basis of his denials,he has no ur reports or anything

you file for an MSC and if they do not settle or stip, you set it for trial and request that discovery close at the MSC. The judge will then issue a findings and award which is essentially the same as a stip and award, but the judge chooses the PD number, that is it.

As to the adjuster going ot the stand for denials...unless the issue of the denials is being litigated, the testimony would be irrelvant
