If the life pension rating is disputed, then that becomes part of the negotiation. If the life pension rating is conceded, then there are actuarial formulas that are used to calculate how long someone is expected to live and what the present value of the life pension is if paid up front instead of in weekly checks over many years. All this is considered part of your total pemanent disability rating and calculated in whatever figure is used to negotiate a settlement with you.

Thank you for the info AYLDT. Now I understand why EVERYTHING is disputed by the IC--they "gotta do what they gotta do" to make sure that the IW doesn't even come CLOSE to the 70% rating, otherwise the life pension entitlement would potentially REALLY cost big $$$....particularly if the IW is relatively young.

when you say the Dr. gave you the 85% rating, is the Dr. Saying

- that your occupation caused 85% of your disability
- your 85% disable from doing your normal and customary occupation


Normally, a DEU rates the report, not the Dr.
