Any recommendations for a rehab counselor in Texas. Injured worker moved from So Cal to Dallas, Texas. Anyone know of any reputable firms in that area. Past experiences? Any information is appreciated.

do you know you are not required to offer VR out of state?

The onus falls to the applicant to prove it is cheaper in TX, you do have to provide (pay for) a counselor for these services, however this may need to be included that the rehab counselor has to run it by phone from here and extra research time for an area the counselor is not familar with.

**An injured worker is entitled to vocational rehabilitation maintenance allowance while the out-of-state vocational rehabilitation plan is being evaluated for cost-effectiveness. (See GTE/Verizon v. Workers Comp. Appeals Bd. (Austin) (2001) 3 WCAB Rptr. 10,061 [writ denied].) State of California, Department of Industrial Relations v. Think you're better off just biting the bullet to begin with / once app picks plan, THEN you can research to see if it's cheaper in state....

I am not mistaken, the code specifically states you are not required to provide VR out of state and the burden shifts to the applicant to provide that they can do it cheaper.

I did NOT say VRMA was not due, I said VR is not due.

Paying in cap VR, paying for a counselor and then rebutting that report has saved many carriers a lot of money.

SO you can rollover, but in the companies I worked in I did prevail on this issue regularly.

No mistakes at all. DIfference in choices and strategy. I have always made the A/A find the counselor and get it done, I did not do the leg work. Great arguments to settle by an RU-122 anyway.
