I read here and on the DWC website many of the finer points of filing liens and getting them paid. However, I haven't found anywhere to learn how to file a lien. Perhaps someone could offer suggestions how to start, whether working through a vendor is necessary or just a good idea, or not. I have hundreds of bills over many years downcoded, refused for payment, or incorrectly paid. I've had carriers pay for a band-aid but not the E/M charge for the visit. It appears many bill reviewers don't understand the "starred procedure" and won't pay for services because they think the charges should be "bundled". Most bills want $5 - $20 of full payment, and it appears I risk the $100.00 filing fee to use this process (or maybe I'm confused).

Any help with the very basic approach to liens would be appreciated.

Hello Doc, You've asked the question at a difficult time to answer because with its' implementation of a paper-free system, the lien filing process is currently in flux. Here are a few basics to get you started:

1. The $100 lien filing fee has been discontinued. There is no fee.
2. Currently, liens must be filed on paper. You can download the form on the DWC web site. I would bet that it is also available here on WCC. The DWC states they will have a new ocular character recognition form available within a few weeks. The DWC copy must be submitted without folds, holes or staples and must include a cover letter listing the documents attached. It can be mailed or hand delivered.
3. Include with your lien a copy of the patient's ledger and any documents you think support your reasons of why the bill should be paid.
4. Copies of the lien and supporting documents must be sent to all parties: the insurance carrier, defense attorney, injured worker or their attorney if they have one and the employer. The exception to this, especially if you are a mental health provider, is that report copies and medical tests are not sent to the employer or the injured worker. A proof of service (form available here on WCC) should be attached to all copies.

As you mentioned, there are many additional details to the nuances of filing and following a lien, but these very basics should get you started. Whether you use a service or not depends in part on the manpower you wish to expend/employ to do the nuts and bolts of filing plus the research to understand liens well enough to see them through to a successful conclusion. It depends on your individual situation and the complexity of your issues. It depends on your understanding of factors such as the OMFS and pre-authorization requirements.

Denise, in addition to your excellent advice, if Docwats wants to be added to the OAR so as to be noticed of any upcoming hearings, he should also copy the WCAB with his EAMS lien.
