IW had Open Reduction Internal Fixation to right forearm. IW was on TD for several weeks, but was never declared MMI. Notwithstanding the fact that there is no MMI report, is the surgical procedure alone ratable, which should prompt C/A to pay PD per LC 4650(b)? Thanks! IM

The only de factor surgical impairments I am aware of are the ones listed under table 16-27. These are for resection or implant arthroplasties, which doesn't like look the case here. Any recent ROM measurements listed in PR-2's?? My best guess is ROM and a long shot 16-25. I say it comes down to case management 101. You probably have the right to not advance pending MMI, but does that help your case if you don't and you think there might be some PD? Last thing you want is to push someone to an AA (new body parts, new issues, etc.). Staff with decision maker, make a decision and document your file.
