Question... is VRMA converted to VRTD if PQME comes in after applicant participated (& stopped for nonmedicalreasons) VR program and says she was not P&S during that period she still wants sx.....?
Facts
On 1/1/04, PTP P&S applicant for leg.
Applicant Starts VR Plan 2/1/04
Applicant ceases VR 5/1/04 because cant pass required aptitude tests for program.
PQME issues report 5/15/04 finds applicant leg P&S 12/1/03, but compensable consequence back injury not P&S if IW wants sx.
VRMA paid 2/1/04 through 5/1/04.
Question
1) Since applicant elects surgery, is she now entitled to VRTD (credit for the difference in benefits paid 2/1/04-5/1/04)?
2) If VRTD owed (difference), 4650d penalty as well?
3) If it is VRTD now, & the applicant starts new plan, is that VRMA outside cap now that it is converted?
Here applicant only completed part of program, but what if she had completed the whole program?
